Terms of Service
These Terms of Service (the "ToS") govern access to and use of the Carousels Generator service, published by Lyten Agency. They form, together with the Terms of Sale and the Privacy Policy, the contract between the Publisher and the User. Registration to the Service constitutes full and unreserved acceptance of these ToS.
1. Purpose
Carousels Generator is an online Software as a Service available at carousels-generator.com that lets Users generate, edit, export and publish carousels intended in particular for the LinkedIn social network, using generative artificial intelligence models. The Service automatically produces the textual content and visual design of carousels from the instructions provided by the User.
2. Definitions
In these ToS, the following terms have the meaning set out below:
- Service: the Carousels Generator platform available at carousels-generator.com and all of its features.
- Publisher: Lyten Agency, a French SAS with a share capital of €1,050, registered with the Paris Trade and Companies Register under number 994 103 547, with its registered office at 200 rue de la Croix Nivert, 75015 Paris, France.
- User: any natural or legal person, whether a consumer or a professional, accessing or using the Service, with or without an Account.
- Account: the personal space created after registration that lets the User access the Service.
- Organization: the multi-tenant workspace attached to one or more Accounts, grouping carousels, brand kits, resources and members.
- Content: any carousel, text, image, video, brand kit, prompt, asset or element created, generated, imported or published through the Service.
- Credits: virtual consumption units allowing the use of artificial intelligence features. Credits are not convertible into currency and are not refundable except in the cases set out in the Terms of Sale.
- Subprocessor: any technical provider involved in the delivery of the Service (hosting, payment, AI, email, analytics, etc.) listed in the Privacy Policy.
3. Acceptance and Modification of the ToS
3.1 Acceptance
Registration, creation of an Account or any access to the Service implies full acceptance of these ToS, the Terms of Sale and the Privacy Policy. The User acknowledges having read them beforehand.
3.2 Modification
The Publisher may amend the ToS at any time to reflect technical, legal or commercial changes. Users will be notified of any material change by in-Service message or by email at least fifteen (15) days before its entry into force. Continuing to use the Service after that date constitutes acceptance of the amended ToS. Otherwise, the User may terminate the Account at no cost.
4. Registration, Account and Security
4.1 Account Creation
Account creation is free of charge. It can be completed using an email and password, or via a third-party identity provider (Google) under the OAuth 2.0 protocol. The User warrants that the information provided is accurate, truthful and up to date (in particular first name, last name, email address and where applicable Organization name).
4.2 Account Security
The User is solely responsible for keeping login credentials confidential. Passwords are stored in derived and hashed form (PBKDF2-SHA256 with 100,000 iterations) and are never accessible to the Publisher in plain text. Any action performed from an Account is deemed to have been performed by its holder. The User undertakes to inform the Publisher immediately of any suspected unauthorized use at contact@lyten.agency.
4.3 Sessions
Sessions have a maximum duration of seven (7) days and are refreshed at each active connection. IP address, User-Agent and last login date are kept for security purposes.
4.4 Minimum Age
The Service is reserved for natural persons aged at least 16, subject for minors to obtaining and providing prior authorization from one or both holders of parental authority. To subscribe to a paid plan, the User must have the legal capacity required (in principle 18 years of age, or be an emancipated minor).
6. Organizations and Members
6.1 Multi-User Structure
Each Account is attached to one or more Organizations. An Organization is a shared workspace that lets several Users collaborate on carousels, brand kits and resources. Created content is attached to the Organization and not to an individual member.
6.2 Roles and Permissions
Available roles within an Organization are: Owner, Admin, Editor, Viewer and Member. The Owner has extended management rights (modifying or deleting the Organization, managing members and invitations). Departure or removal of the last Owner is forbidden; another Owner must be appointed beforehand.
6.3 Invitations
An Owner or authorized member may invite new Users to join the Organization by email. Invitations are valid for seven (7) days from issuance and may only be accepted by the holder of the recipient email address. If the invitation is not accepted within that period, it lapses.
6.4 Owner Responsibility
The Owner is responsible for how the members of the Organization use the Service and for the Credits and subscriptions attached to the Organization. The Owner ensures that members comply with these ToS.
7. Credits and Consumption
7.1 Principle
Credits are virtual consumption units allowing the use of generative AI and analysis features. They are granted monthly based on the subscribed plan, or occasionally (referrals, welcome bonus, support adjustment).
7.2 Consumption per Action
As an indication and subject to change, the Credit costs of the main actions are:
- Carousel generation: 5 Credits
- Global edit via AI chat: 3 Credits
- Targeted edit on one or two slides: 1 Credit
- Brand Kit import and analysis (URL or PDF): 5 Credits
- LinkedIn caption generation: 1 Credit
- Direct publication on LinkedIn, Threads or Instagram: 3 Credits
- Thread publication on X (Twitter): 1 Credit per slide
- Simple AI question without modification: 0 Credit
7.3 Renewal and Expiration
Credits included in a subscription are renewed at the start of each billing cycle and do not roll over from one cycle to the next, unless expressly stated otherwise. Bonus Credits (referrals, gifts, etc.) remain available for as long as the Account is active.
7.4 Non-refundable Nature
Credits are not convertible into currency, transferable or refundable, except in the cases expressly set out in the Terms of Sale (in particular the 14-day guarantee).
8. Plans and Functional Limits
The Service offers a free plan and several paid plans. The quotas displayed below are synchronized in real time with the Service configuration and may evolve. The full and up-to-date features of each plan are published on the pricing page:
- Free Plan: 20 Credits per month, up to 5 stored carousels, 1 brand kit, public carousels by default, watermark on exports, no web search.
- Starter Plan: 150 Credits per month, unlimited carousels and brand kits, watermark-free exports and premium templates.
- Pro Plan: 500 Credits per month, Tavily web search, private carousels and priority support.
- Scale Plan: 1,500 Credits per month, advanced features and early API access (coming).
8.1 Free Trial
On registration, the User automatically benefits from a Pro plan trial for seven (7) days, with no payment method required. At the end of the trial, the Account automatically reverts to the Free plan unless a paid subscription is purchased.
9. Usage Rules
9.1 Authorized Uses
The User may in particular:
- Create carousels for personal or professional use;
- Publish carousels on LinkedIn and other social networks;
- Use carousels for commercial purposes (marketing, client work, training, etc.);
- Reuse, adapt and modify generated carousels freely.
9.2 Prohibited Uses
The following are strictly prohibited:
- Using the Service to create or distribute defamatory, abusive, hateful, racist, sexist, discriminatory, pornographic, child-exploitation, terrorist, illegal content or content infringing third-party rights (in particular copyright, trademarks, privacy, image rights);
- Spreading false or misleading information likely to harm public order;
- Creating content impersonating a natural or legal person (unauthorized deepfakes, fake profiles, etc.);
- Attempting to circumvent technical limitations, quotas, the Credit system, the watermark or the Service security mechanisms;
- Using bots, scripts, scrapers or any unauthorized automated means to access or overload the Service;
- Reselling, sublicensing or making access to the Service or Credits available to a third party, without prior written authorization from the Publisher;
- Reverse-engineering, decompiling or reproducing the source code or AI models;
- Sharing Accounts or pooling an Account between several distinct natural persons;
- Submitting prompts intended to extract or bypass system instructions of the AI models (prompt injection);
- Abusing carousel generation, in particular by requesting an excessive or unreasonable number of slides per generation, with the sole purpose of consuming Credits, stress-testing the Service, or producing content without a legitimate creative or professional purpose;
- Any usage pattern inconsistent with normal good-faith use of the Service, including repeated identical or near-identical generations in rapid succession, or any other behaviour designed to disproportionately consume AI compute resources or harm Service availability for other Users;
- Any activity unlawful under French, European or local law applicable to the User.
10. Content Generated by Artificial Intelligence
10.1 AI Providers
The Service relies primarily on Google generative AI models (Gemini family) for text generation, image generation and brand kit analysis. The Service may also rely on third-party search engines (Tavily) for web search features. The complete and up-to-date list of subprocessors is set out in the Privacy Policy.
10.2 Limits and Warnings
The User expressly acknowledges that AI-generated content may contain inaccuracies, factual errors, omissions, biases or "hallucinations". It is the User's responsibility to check, proofread and validate any information before publishing or distributing it, and to carry out additional research where necessary. The Publisher cannot be held liable for the consequences of unverified publication.
10.3 Moderation
The AI models used include safety filters intended to block content prohibited by their provider. These filters do not guarantee perfect coverage. The Publisher may, at any time and without notice, refuse a generation, remove manifestly illegal content, or suspend an Account that abuses the Service.
11. User Content
11.1 Ownership of Generated Content
The User retains all property rights over the Content generated through the Service, including for commercial and resale purposes, within the limits of the rights granted by third-party AI providers and subject to compliance with these ToS. The Publisher claims no ownership over the generated Content.
11.2 License Granted to the Publisher
The User grants the Publisher a non-exclusive, worldwide license, for the duration of legal protection, to use, reproduce, adapt, communicate to the public and display the Content for the sole purposes of (i) providing the Service, (ii) ensuring its improvement and security, (iii) illustrating its promotional materials (portfolio, demonstrations, communications) and (iv) displaying it in the public Discover gallery when the User has marked the carousel as public.
11.3 User Warranties
The User warrants that any content, image, prompt or resource imported into or submitted to the Service does not infringe any third-party rights, and that the User holds the necessary authorizations (in particular copyright, image rights, neighboring rights and trademarks). The User indemnifies the Publisher against any action, claim, demand or judgment based on the breach of such rights.
12. Discover Gallery
The Service offers a public Discover gallery that lets the community of Users share and discover carousels.
12.1 Default Visibility
Carousels created on the Free plan are public by default and may be displayed in the Discover gallery. Paid plans allow carousels to be kept private.
12.2 User Control
Users may switch a carousel to private from their personal space, provided they have an active paid plan. When a carousel is public, it can be viewed, duplicated and liked by other Users. Duplication does not grant any rights over the original carousel.
13. Third-Party Integrations
On every plan, the Service offers OAuth integrations enabling direct publication of content on third-party social networks (LinkedIn, X, Threads, Instagram). Each publication consumes Credits according to the table on the pricing page.
13.1 OAuth Consent
When connecting a third-party account, the User expressly authorizes the Publisher to publish on their behalf under the conditions set by each network. Access tokens are stored securely and may be revoked at any time from the User's space or directly with the third-party network.
13.2 Third-Party Conditions
The User remains solely responsible for compliance with the terms and moderation rules of each third-party platform (LinkedIn, X, Threads, Instagram). The Publisher cannot be held liable for the suspension of a third-party account resulting from a publication made through the Service.
14. Referral Program
14.1 Principle
Each User has a unique referral code. When a new person signs up using that code, the referrer receives twenty (20) Credits and the referred user receives ten (10) additional Credits, on top of the welcome bonus.
14.2 Rules
Referrals are limited to genuine signups. Self-referrals, duplicates, fake accounts and signups that do not comply with the ToS are prohibited and may lead to cancellation of the granted Credits and to suspension of the relevant Accounts. The Publisher reserves the right to amend or terminate the program at any time.
15. Affiliate Program
A separate affiliate program, operated through Lemon Squeezy, allows partners to earn commission on payments generated through their affiliate link. Membership, remuneration and payment conditions are governed by a separate affiliate agreement, available on request at contact@lyten.agency.
16. Promotional Codes
The Publisher may, on a case-by-case basis, offer promotional codes granting discounts on subscriptions. These codes are strictly personal, non-cumulative unless otherwise stated, valid for the period indicated and subject to the specific conditions of each campaign. Any fraudulent use entails cancellation of the discount.
17. Publisher's Intellectual Property
17.1 Rights to the Service
The Service, its source code, interfaces, databases, templates, system prompts, design, trademarks and logos are the exclusive property of Lyten Agency. Any total or partial reproduction, representation, adaptation, translation or decompilation without prior written authorization is prohibited and constitutes infringement punishable under articles L.335-2 et seq. of the French Intellectual Property Code.
17.2 Trademarks
"Carousels Generator" and "Lyten Agency" are trademarks operated by the Publisher. Any unauthorized use is prohibited.
18. Liability
18.1 User Liability
The User is solely liable for the Content they generate, import, publish or distribute through the Service. In particular, the User is liable for compliance with third-party rights, the rules applicable to publishing platforms, statutory marketing and communication obligations, and the accuracy of any disseminated information.
18.2 Limitation of Warranty
The Service is provided "as is" and "as available". The Publisher uses commercially reasonable means to ensure availability, security and reliability of the Service, without guaranteeing that it will be free from errors, bugs or interruptions. The Publisher may temporarily suspend the Service for maintenance or in case of force majeure.
18.3 Liability Cap
Within the limits permitted by law, and except in cases of willful misconduct, gross negligence or bodily injury, the Publisher's total liability towards a User, all damages combined, may not exceed the total amount actually paid by that User during the twelve (12) months preceding the triggering event. The Publisher cannot in any case be held liable for indirect damages, loss of business, loss of opportunity, loss of data or harm to image.
18.4 Force Majeure
The Publisher cannot be held liable for delays or failures resulting from circumstances beyond its reasonable control, such as network outages, provider failures (Cloudflare, Google, Lemon Squeezy, etc.), cyberattacks, labor disputes, administrative decisions or events qualifying as force majeure under French case law.
19. Suspension and Banning
19.1 Grounds
The Publisher may suspend, restrict or delete an Account, without prior notice or compensation, in the following cases:
- Serious or repeated breach of these ToS;
- Generation or distribution of prohibited content (article 9.2);
- Fraudulent or abusive behavior, or behavior threatening the security of the Service;
- Persistent payment default after formal notice;
- Reasoned request from a competent judicial or administrative authority;
- Suspicion of identity theft or infringement of third-party rights.
19.2 Procedure
Suspension may be temporary or permanent. The reason is notified to the User by email, in French and English. The User may submit observations to contact@lyten.agency within fourteen (14) days. After review, the Publisher may maintain, lift or aggravate the measure.
19.3 Consequences
During suspension, access to the Account and Content is restricted. Subscriptions in progress are not refunded pro rata, unless otherwise decided by the Publisher. In case of permanent deletion, Content may be deleted after a reasonable archiving period, subject to legal retention obligations.
20. Termination
20.1 Termination by the User
The User may, at any time and at no cost, request the deletion of the Account from the personal space or by email to contact@lyten.agency. Deletion is immediate and entails removal of the Content attached to the Account in accordance with the Privacy Policy. Amounts paid under an ongoing subscription are not refunded pro rata, except as provided in the Terms of Sale.
20.2 Termination by the Publisher
The Publisher may terminate this contract with thirty (30) days' notice, by notification sent to the User's email address, in case of total or partial discontinuation of the Service, or immediately in the event of a serious breach by the User.
21. Governing Law, Mediation and Jurisdiction
21.1 Governing Law
These ToS are governed by French law.
21.2 Consumer Mediation
In accordance with article L.612-1 of the French Consumer Code, a User who is a consumer may, after attempting to resolve the dispute amicably with the Publisher (by email to contact@lyten.agency), refer the matter free of charge to a consumer mediator with a view to amicable settlement, within one (1) year from the written complaint.
21.3 Jurisdiction
Failing amicable resolution, and subject to the mandatory rules applicable to consumers, any dispute relating to these ToS shall be submitted to the courts having jurisdiction within the area of the Paris Court of Appeal.
